2. Acceptance of Terms
By creating an account, accessing, or using any part of our Service, you confirm that:

- You have the legal capacity to enter into binding agreements
- You will comply with all applicable laws and regulations

Webstadia provides:
- Static Hosting: High-performance CDN-powered hosting for static websites and applications
- PHP/WordPress Hosting: Managed hosting powered by CyberPanel with LiteSpeed optimization
- Content Management System: Built-in CMS with templates, subscriber management, and direct URL routing
- Data Tables: Backend-free database storage accessible via REST API
- Form Management: Intelligent form submission handling with spam protection
- Developer Tools: GitHub integration, preview deployments, and NPM packages
3.2 Service Availability
While we strive for 99.99% uptime, we do not guarantee uninterrupted or error-free operation of our Service. Scheduled maintenance will be communicated in advance when possible.
4. User Accounts and Security
4.1 Account Registration
When creating an account, you must:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Choose a strong, unique password
- Keep your login credentials confidential
4.2 Account Security
You are responsible for all activities under your account. You must immediately notify us of any unauthorized use or security breach. We are not liable for any loss or damage arising from your failure to protect your account.
5. User Content and Intellectual Property

You retain all rights to Content you upload to our Service. By using our Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your Content solely for the purpose of providing and improving our Service.

Our current pricing is available on our website. We reserve the right to modify prices with 30 days' notice. Price changes will not affect existing subscriptions until renewal.

- Payments are non-refundable except as required by law
- You authorize us to charge your payment method automatically
- Failed payments may result in service suspension
7.3 Free Tier
Our free tier is provided as-is with limited resources. We reserve the right to modify or discontinue free services at any time without notice.
8. Data Protection and Privacy
Your use of our Service is also governed by our Privacy Policy. We implement industry-standard security measures to protect your data, but cannot guarantee absolute security. You are responsible for maintaining backups of your Content.
9. Termination
9.1 Termination by You
You may terminate your account at any time through your account settings. Upon termination, your right to use the Service will immediately cease.
9.2 Termination by Us
We may suspend or terminate your account if:
- You violate these Terms or our policies
- Your account has extended periods of inactivity
- We are required to do so by law
- We discontinue the Service
9.3 Effect of Termination
Upon termination, we may delete your Content and account information. We are not obligated to provide access to your Content after termination. Provisions that should survive termination will remain in effect.
10. Disclaimers and Limitations

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEBSTADIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
10.3 Maximum Liability
Our total liability for any claims under these Terms shall not exceed the amount paid by you to us in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless Webstadia, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
12. Modifications to Terms
We may modify these Terms at any time. Material changes will be notified via email or through the Service at least 30 days before taking effect. Continued use after changes constitutes acceptance of the modified Terms.
13. API Terms and Developer Guidelines
13.1 API Access
If you use our APIs, you must comply with our API documentation and rate limits. We reserve the right to modify, suspend, or discontinue API access at any time. You may not use our APIs to:
- Exceed rate limits or circumvent usage restrictions
- Create competing services or products
- Access or store data in violation of privacy laws
- Perform bulk data extraction without permission
- Compromise the security or performance of our Service
13.2 Developer Responsibilities
When building applications that integrate with Webstadia:
- Implement proper error handling and respect rate limits
- Maintain secure storage of API credentials
- Clearly disclose your relationship with Webstadia to end users
- Comply with all applicable laws and regulations
- Promptly address security vulnerabilities
14. NPM Package and Open Source
14.1 NPM Package Usage
Our NPM packages (@webstadia/client, @webstadia/cms) are provided under specific licenses. By using these packages:
- You agree to comply with the applicable open source license terms
- You acknowledge that packages are provided "as is" without warranty
- You must not remove or alter any license notices
- You are responsible for your implementation and any issues arising from it
14.2 Contributions
If you contribute to our open source projects, you grant us a perpetual, worldwide, non-exclusive, royalty-free license to use, reproduce, and distribute your contributions.
15. Service Level Agreement
15.1 Uptime Commitment
For paid plans, we commit to maintaining 99.9% uptime, measured monthly. This excludes:
- Scheduled maintenance (communicated 24 hours in advance)
- Force majeure events beyond our reasonable control
- Issues caused by your actions or third-party services
- Beta features or free tier services
15.2 Uptime Commitment
We strive to maintain a high level of service uptime. While we aim for optimal availability, we do not offer any compensation for downtime.
16. Compliance and Export Controls
16.1 Export Compliance
You may not use our Service in violation of export control laws and regulations. You represent that you are not:
- Located in a country subject to U.S. trade sanctions
- On any prohibited party lists maintained by the U.S. government
- Using the Service for prohibited end uses including nuclear, missile, or weapons development
16.2 DMCA Compliance
We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). To report copyright infringement, send a notice to our designated agent including:
- Identification of the copyrighted work
- Identification of the infringing material
- Your contact information
- A statement of good faith belief
- A statement of accuracy under penalty of perjury
- Your physical or electronic signature
17. Beta Features and Testing
17.1 Beta Services
We may offer beta, preview, or early access features ("Beta Features"). These are provided for testing and evaluation purposes and may be discontinued at any time. Beta Features:
- Are provided "as is" without warranty or SLA
- May contain bugs or errors
- Should not be used for production workloads
- May be subject to additional terms
- Feedback may be used to improve our Service
17.2 Testing and Feedback
By using Beta Features, you agree to provide feedback and bug reports. We may use this feedback without compensation or attribution to improve our Service.
18. Professional Services
18.1 Consulting and Support
If you purchase professional services, consulting, or premium support:
- Services are subject to separate statements of work
- Deliverables are provided on the agreed timeline
- You must provide necessary access and cooperation
- Additional fees may apply for scope changes
- Support response times vary by plan level
18.2 Training and Certification
Any training materials or certifications provided are for your internal use only and may not be redistributed or resold without permission.
19. General Provisions
19.1 Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.
19.2 Entire Agreement
These Terms, along with our Privacy Policy, Data Processing Agreement (if applicable), and any other policies or agreements referenced herein, constitute the entire agreement between you and Webstadia.
19.3 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. The unenforceable provision will be modified to reflect the parties' intention.
19.4 Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction, including in connection with a merger, acquisition, or sale of assets.
19.5 Waiver
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision shall not constitute a waiver.
19.6 Force Majeure
Neither party shall be liable for any failure or delay in performance due to circumstances beyond reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
19.7 Relationship of Parties
Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship. You have no authority to bind us in any manner whatsoever.
19.8 Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights except where expressly stated. Our licensors and service providers are intended third-party beneficiaries with the right to enforce provisions related to their intellectual property and services.
